District U32 - Area of Patrimonial Protection Antiguo Puerto Madero

1) Character: zone devoted to enlargement and complementation of the uses of the Central Area, developed on a sector of the Antiguo Puerto Madero that includes docks 1, 2, 3, 4, their shoulders and buildings of the adjacent warehouses. This sector, no longer affected to its port function, keeps a high patrimonial, architectonic and environmental value that must be preserved.

2) Limits: the District U32 is limited by: axis of the Av. Eduardo Madero from its intersection with Av. Córdoba; axis Av. Eduardo Madero - Ing. Huergo up to its intersection with the axis of Av. Brasil, by the axis of Av. Brasil up to its intersection with Bartolomé Mitre y Vedia Street; the axis of the Bartolomé Mitre y Vedia Street up to its intersection with the virtual extension of the L.O. of the north sidewalk of Viamonte Street; by the virtual extension of north sidewalk of Viamonte Street up to its intersection with the west end of the communication channel between Dársena Norte and Dock 4; by the west end limit of the communication channel between Dársena Norte and Dock 4 up to its intersection with the virtual extension of the axis of Av. Córdoba; by the virtual extension of the axis of Av. Córdoba up to its intersection with the axis of the Av. Eduardo Madero, as shown in Plan Nr. 5.4.6.33 (Nr. 2015-B-CPU-92).

3) Subdivision: plots 1 to 8 indicated in Plan Nr. 5.4.6.33 must remain undivided. The measure, the plans of the opening of the public way and of plot subdivision, will be approved by the cadastral office, who will verify the accordance with all dispositions contained in the paragraph 5.1. Circulations.

The limits of the mentioned plots remain defined as follows:

Plots 9, 12, 13 and 16: the L.O. east and west will be coincident with the projection of the existing buildings.

Plots 10, 11, 14 and 15: the L.O. west will be placed 15.50 m of the west façade of the existing buildings.

Plots 9 to 16: the division line between neighboring plots will be placed equidistant from the side of the façades of the buildings.

Plots 1 and 18: the division line between plots will be placed coincident with the virtual extension of the L.O. of the north sidewalk of Viamonte Street.

Plot 17: the L.O. will be placed 10,00 m from the south end of Dock 1 and at the same distance from the southwest end of the communication channel between Dock 1 and Dársena Sur. At the same time, at 31,00 m from the axis of Av. Brasil and at 6,00 m from the line of projection of the junction board of the Buenos Aires - La Plata Highway with the 25 de Mayo Highway. As shown in Plan Nr. 5.4.6.33 c).

Plot 18: the east L.O. will be placed at 23,00 from the west end of the communication channel between Dársena North and Dock 4; the west L.O. will be at 2,50 m of the sidewalk edge of the Viamonte Street; the south L.O. will coincide with the virtual extension of the L.O. of the north sidewalk of Viamonte Street; the north and northwest L.O. will be situated at no more than 59 m of the south L.O. As shown in Plan Nr. 5.4.6.33 c).

Plot 16: the southwest L.O. will be at 6,00 m from the projection line of the junction board of the Buenos Aires - La Plata Highway with the 25 de Mayo Highway.

4) Building typology:

a) For plots 1 to 16 the typology of the existing buildings, as established in the original project of Puerto Madero, will be kept, allowing only the modifications and enlargements of point 5.2.1.2.

b) For plot 17: it will be ruled by the dispositions established for the District E3 of zonification, excepting for what concerns to FOT and FOS, which are set as follows:

Maximum FOT: 1
Maximum FOS: 60%
As shown in Plan Nr. 5.4.6..33 b)

c) For plot 18: buildings of free perimeter are allowed.

Maximum FOT of the plot: 7 (seven)

Area that can be modified: it is determined by the area within the northeast, east, south and north L.O. of the plot. The west limit will be determined by the virtual extension of the external west face of the existing building in plot 1 (one), as shown in Plan Nr. 5.4.6.33 c).

Free areas of the plot: the free areas of the plot will remain for public use. This obligation will be established through administrative servitude, officialized through public title deed.

base:

Height: must be equal to the height of existing building in plot 1.

FOS: It could be used the entire area of the plot where can be built.

Particular Dispositions:
a) the base must have a minimum development of 35,00 m over the building west line of the plot;
b) all its faces must have a façade treatment.

Buildings with free perimeter:

Maximum Height: it cannot be higher than a horizontal limit plan at 120,00 m.

FOS: 50%

c) total or partial destruction: in case of total or partial destruction of any building subject of patrimonial protection, the destroyed building could only be replaced by another of the same type, according to the original project, as far as built volume and façade height. The location of the building to be rebuilt must be coincident in its horizontal projection with the same of the destroyed building.

5) Circulations

5.1 Circulations: the area will have the following circulation system:

5.1.1 Vehicles:
North-South: on the West side of the District, Buenos Aires - La Plata Coastal Highway and paralell local street; on East side, Av. Bartolomé Mitre y Vedia.

East-West: going-through avenues that will link the city with South Waterfront, in coincidence with the existing bridges over the channels that link the docks.

5.1.2 Pedestrians:
A public way only for pedestrians will be established around the docks, out of the perimeter strip of 1,20 m; this circulation will have a width which will be equivalent to the distance between the L.O. East of the plots and the west end of such operation strip. In the 3 remaining sides of each dock a minimum width of 8,00 m will be kept.

5.1.3 Boats:
Along the docks and in coincidence with their axis, a central water way of circulation will be kept between the North and South DARSENAS.

5.2. Obligation to protect:
For the area, two protection forms are established, accordint to their application, building protection and environmental protection, in order to preserve the architectural - environmental value as a memory of the city. The building protection refers to what was built on the plots, while the environmental protection refers to the either public or private space surrounding the old docks to be protected and their banks.

5.2.1 Building protection:
In the area are declared subject to protection the warehouses (Docks) built on the west side of the docks, which cannot be demolished.

Particular cases:
a) In order to allow the value and new functioning for uses other than the originals, of the above mentioned buildings, the following interventions, established in 5.2.1.1 and 5.2.1.2 are allowed:

b) In the cases of Plots 9, 13 and 15, the destroyed sector of the original buildings must be built. The new construction must be done according to point 4).

c) In the case of Plot 16, should the vial affectation of the Buenos Aires - La Plata Highway still operates, it must be fulfilled the disposition of point 4).

5.2.1.1 In the outside:
Consolidation and mainteinance of the façades, galleries and doorways respection their materials as well as their design in shape and dimensions. New windows will be admitted in the side façades if their design is contextual with the original work.

- The existing galleries and doorways cannot be closed not even with transparent elements, only being allowed the use of handrails.
- No air conditioner or heaters installations will be admitted if they are visible from the outside.
- In the façades, the rellocation of connections, control units or any other installations from the public services companies must be approved by the Council, who will handle with the companies that supply the service the adequation of the norms about these installations and the pecularities of the district.

The surface of the façades must be treated with colorless and transparent materials to ease the removal of signs, spray paintings, etc. without any alteration or deterioration, after its restoration.

5.2.1.2 Modifications and enlargements
The basic guidelines of the existing volumes must be respected, being admitted:
a) The adding of a mezzanine on the last floor without modifying the existing façades.
In the roof it is allowed to reproduce the general guidelines of the existing ones or the construction of roofs at 4 waters. For this second option, in all cases the pitch of the roof must be of 25%. The maximum height of the roofs cannot exceed a horizontal plan at more than 3,50 m of height of the existing façade. On the roofs no emerging volume is allowed. It is permitted to put skylights or glass roofs.

The water distribution tanks, locals or for elevators machines, air conditioning installation or any other similar element must be contained withing the volume, either real or virtual, conformed by the roofs in a way that they are not visible.

a1) In the case of plots 9, 12, 13 and 16 the option to which the point 5.2.1.2 a) refers, the maximum height of 4,50 m over the existing façade must be respected.

b) Between the warehouses, in a strip located at a minimum distance of 1/3 of the width of the building, about the encounter of façades, is allowed: (figure 5.4.6.33)

b1) To add a volume to the lateral façades of the building with a maximum lenght of 1/6 of its width. Its maximum area in plant of such volume will be 30 m2 and its height will coincide with the height of the inferior cornice of the façade to which it is added.

In case of a vertical circulation, stairs or elevators, a volume could be added fulfilling the mentioned functions and being admitted as maximum height of such volume the maximum height admitted for the roof of the building (dock).

b2) Up to two exempted buildings per plot, catered to commerce or service, corresponding, each one of them, to each of the lateral façades of the buildings. The maximum covered area for each one will be 15 m2; in case of agreement between plots, it is allowed to add the areas up to 30 m2 in one construction; if the plot is next to the lateral vehicle way (plot in the corner), will also be allowed to reach the 30m2 in that place, and a maximum height of 4,50 m. To determine the minimum distance of 1/3 of the width of the building will always be considered the smallest widht of these.

In no case, in order to preserve the visuals up to the docks, the constructions between the warehouses admitted in points 1 and 2 could reach together a lineal development superior to 1/3 of the distance between the original façade and the side end of the plot.

c) Below the line of the plot it is allowed the total occupation with basements for parking, loading and unloading, and auxiliar services for the buildings. In these basements can be developed the main use and complementary uses as well only in cases of buildings for educational purposes, and when the parking and services requirements have been all fulfilled. The urban space will be considered from the line - 3,50 m.
d) The modifications that are made inside the buildings cannot produce any alteration in the façades. In case of configurating internal patios or yards, the relation r= h'/d' = 1,5 must be respected.


5.2.2 Environmental protection:
It involves the actions for the protection of the public and private space surrounding the buildings, the open areas, streets and sidewalks, the four docks and their shoulders, the elements of the original port activity and urban equipment.

Urban equipment
Street signals and lamps

The elements that hold signals and lamps, those that delimitate the access to parking lots and those belonging to public services companies will be painted in colors that create harmony with the rest. The projects for external lightning of the buildings and the open areas of the plots will have coherence and cromatic unity and must be approved by the Council. The lightning columns cannot be used to fix reflectors, speakers or other elements alike.

Furniture
The design and placing of urban furniture components (sales and control points, bus-stops, banks, thrash cans, etc.) must have the approval of the Secretary.

The characteristical elements of the original port activities must be respected, refurbish if they were damaged or replaced if they are missing, if possible (due to the impossibility of going back to their original production process).

b) Canopies and awnings:
Can be used on the west façade and on the laterals as well of the ground floor of the buildingns. They must be of one type and color per building, made of transparent materials in the canopies and or the fabrics of the awnings. No announces of any kind are permitted: only the name and / or company name will be allowed in the awnings. The projects will be submitted for the Council consideration.

c) Advertising:
In the façades of the buildings frontal inscriptions, being of single or independent letters. It is forbidden to place volumetric vadvertisements, structures or any other element on top of the buildings. The projects must be submitted for the Council consideration.

d) In the water areas of the docks:
Along the docks and in coincidence with their axis, a central way of water communication must be kept between the North and South DARSENAS. Such way must remain free of any element that does not allow the free circulation in a width of 40 m. At both sides of this way could be placed marinas, wharfs, surveillance cabins, and other equipment for the service and comfort of sailors as long as their installations are floating ones.

e) Exterior SOLADOS:
They must respect the original environment of the area, refurbishing the existing paving stones or replacing it if it was missing. On the division line of the plots only landmarks could be placed and / or some modifications in the design of the SOLADO with the original material in order to keep the space continuity of the open area.

f) Trees:
The existing trees must be conserved. In the limit strip with the highway and in the areas of public parking, trees with appropriate characteristics to the function they will have could be planted.

g) Maintenance
The maintenance and conservation of lights, gardens and surveillance of the open areas of private domain but for public use, will be under responsibility of the owners of each plot.

6) Uses:

a) For the plots occupied by buildings subject to protection, the uses will be those that result of the application of the Chart of Uses No. 5.2.1 for the District C1 of zonification (A.D. 610.24).

The following uses are aslo permitted:

· Auctions houses.
· Exhibition centers.
· Social, cultural and sport clubs (indoor installations).
· Art and craft ateliers.
· Touristic services and those related to by water transportation.

Observations: the 50% of what is requested by the Chart of Uses No. 5.2.1 about parking, and the 100% of what is requested for loading-unloading:

a1) The permitted uses for the plots 9, 10, 11 and 12 are only for educational, cultural and sport activities, and commerce related to those activities.

b) The free, open areas of the plot:
The open areas of the plot are released for public use. This obligation will established through administrative servitude, settled down by public title deed. In these areas there could be placed tables, chairs, parasols and auxiliar servicies of cafeteria, drinks and leisure according to the main uses of the buildings.
Regarding shape, use and occupation of the ground with the furniture for the activities in the open areas, these are submitted for the Council approval.

c) For the water areas of the docks the following uses are permitted:

· Mooring rope for boats.
· Floating wharfs for mooring ropes for boats.
· Dressing rooms and alike activities.
· Floating ponts for security, surveillance and administration.
· Exhibition, sales or renting of boats.
· Exhibition of boats or ships with historical values.
· Exhibition of floating, itinerating shows.
· Water and sport activities and their social sites.
· Administration, gastronomy, warehouse and boxes.
· Touristic services and those related to by water transportation.
· Floating gas point.
· Naval warehouse.
· Yachting school.
· Water sports school.

Each one of the activities must have the minimum services that ensure its work with autonomy and be installed on floating areas. To prevent any environmental agression or pollution, all admitted constructions must be connected to the general services net.
For the floating areas a maximum FOS = 0,05 is permitted.
In each dock the gastronomy use could only reach 10% of the maximum allowed FOS.
The placing of the permitted uses could only occupy up to 40% of each side of the docks, and each one will have a lineal development on each side of the docks no longer than 15 m.
The constructions on these areas must respect a limit plan of 4,50 m from the line of the wharf.
The boats with historical interest must have as an exhibition frame an area made by the side of the dock that each boat occupies plus a strip of 30 m at each side of the boat free of all occupation, and also the water area between this sector and the central way of water communication.

d) Public parking in private domain:
For the open areas of the plots occupied by buildings subject to protection, released for public use, a minimum of 10% and a maximum of 20% of the area of the plot must be kept for public open air parking, placed in correspondence with the west façade of the buildings, and adjacent to the L.O. of the plot. Its construction will be made by the owners and the general guidelines set by the Council must be followed.

e) Public way

e1) Activities in the areas released for public use:
In the open areas there could be placed tables, chairs, parasols and supporting elements for leisure and cultural activities, as long as these elements are not fixed. These activities must be carried out in a strip of maximum width of 4,00 m adjacent to the building, not being allowed to exceed 50% of the area devoted for pedestrians.

e2) Parking in the public way:
It will be developed in the free area between the docks and at both sides of the transversal circulation ways. The mentioned parking will be of public use.

f) For the plot 17 the uses of the E3 District are permitted, according to the Chart of Uses No. 5.2.1. The following uses are also allowed without restrictions:

Selling of sport boats and accesories
Naval warehouse
Boats parking
Selling points of gas for boats
Maintenance workshops and supporting services for the boats and water activities to be carried out at the docks.
Heliport

g) For the plot 18 the uses of the District C1 are admitted, according to the Chart of Uses No. 5.2.1.
